Actually they are as Spam Act 2003 covers all citizen of Australia
regardless of where the they are located in the world and all
Australian email addresses regardless of the citizenship of the
address owner.  Now prosecuting a offence is hard if it is a offshore
spammer but the offence itself occurs.
