A fire, as far as I can see, falls withing "Circumstances beyond
the control of the provider".  If it is determined that the fire
was caused by the actions/in-actions of a employee then it would
not be exempt.  The exemption would be provisional until there is
a determination of the fire's cause.

 (2)   Circumstances beyond the control of the provider may include (but are not limited to) the following circumstances:
                (a)    damage to a facility of the carriage service provider that is not caused by the carriage service provider;
