At the end of the day any regulation introduced around speeds will only
work to discourage innovation beyond the then defined minimum or standard.
I don't see how consumers would win.

You're right in saying this is a job for the marketing department. You can
see it already with ISPs striving to top other "real" measures such as
Netflix and YouTube performance.

As you said the NBN has lifted those expectations significantly. It's not
just the RSPs who have been at fault but government representatives and NBN
Co itself with claims of speed. On top of this I'd also suggest that the
the NBN halted much progress in the retail market making the gap between
reality and expectation larger again. Only recently has the issue of
affordability been discussed outside of these forums. It may be the case
that internet becomes less accessible now due to the cost.
