How could they tell ? 

Since the content of emails are not part of DR, and subject = content,
therefor not part of data to be retained or released, they'll still have
NFI if that person emailed the other person about a concern, or what
they got up to last weekend... 

To get to your example they need full access to content which does
require a Court order.
