The problem with this Joseph is that we aren’t the consumer, we are the provider, and it’s our upstream that is getting the requests rejected, the losing carrier seems to think there is nothing they can do about it and can’t see any issues, the gaining carrier (our upstream) reckons they can’t do anything about it, the TIO is helpless in such cases (I have spoken to them) and I am still trying to get hold of somebody from the ACMA to talk to.
We have a feeling that NBN have something to do with this issue as it’s in an active disconnection area and due to be disconnected soon, but we can’t get anywhere with them either…..

DOT, TIPT, PSTN, VoIP it really shouldn't matter.
If they are seemingly refusing to accept the port-out request from the new provider then perhaps you should be contacting ACMA to see if they can help.

Under Compliance for providers, they note the telco act '97 (http://www.comlaw.gov.au/Series/C2004A05145), part 31 proceedings for refusing to port a number.
YOU as the consumer, shouldn't have to do anything except to say to NEW provider "Here's number, heres account number, please port", the NEW provider should be doing the requests/talking with Telstra in regards to porting that number over. Is this the process your having?
If it is currently DOT then that can be delivered via PSTN i believe - and if it is an NBN area and the numbers already been listed as pending disconnect you may need to get it converted to an EBD service first (have had to do a few of these annoyingly), but again this should be a fairly pain-free procedure.

But NBN has nothing to do with a service or your ability to port the number around.
You statement should read “Porting numbers when VOIP providers that don’t have porting agreements involved seems to be a nightmare”
At the end of the day the NBN UNI-V service is just a VOIP service.

Porting numbers when NBN is involved seems to be a nightmare.
We have been trying to port a PSTN number from Telstra to our VOIP for weeks, the problem is that as it’s in an NBN disconnection area NBN have marked it as pending disconnection so the VOIP carrier isn’t able port it, it’s really a nightmare when NBN is involved with anything.

With the process moving to RAN verification it shouldn't have any problems. You put the application to the new provider and provide the account number that is on the invoice that Telstra bill you for the service on. What reasons have they given to deny this process? They shouldn't realistically have a say in the matter.
