The FAQ is Attorney General's view of the Act, but not conclusive.

What you're actually required to do, is submit and implement a data
retention plan to the CAC, but only if you fall within the ambit of the
act. If the CAC doesn't agree with your interpretation, you can appeal to
the ACMA, and from there there would be legal appeal. Or you can just give
the CAC whatever they ask for.
