Based on what Optus claim, you have a reasonable expectation.
If for some reason you don't get faster downloads, you ask for your money back and cancel your contract because they didn't deliver what they claimed.
BTW, they aren't the first ISP, and won't be the last, to make claims they can't deliver (*still annoyed the Full High court recently ruled in TPG's favour on their 'unlimited ad' claims - in my view TPG should not be advertising this claim unless the majority of the population can receive this offer or they clearly spell out the areas in which it is available in font sizes as large as the ad).

Optus charges $20/month additional for a DOCSIS 3.0 modem with a higher link speeed to be provisioned [1]. If I was paying that extra $20/month I would expect to faster downloads even if the traffic is flowing over congested links controlled by Optus.
Otherwise it is just a con.
