The arm's-length stuff has been going on for ages - but putting it on a formal basis, with documentation, achieves the opposite of plausible deniability, does it not?

Plus, the act of compromising computers in order to form a botnet is illegal in most jurisdictions, whether or not one does anything with said botnet.
