[AusNOG] APNIC WHOIS

Hey Karl,

You have to pretty careful what you post on social media forums as it can come back to bite you in the A$$. At one time or an other everyone has felt this but in this day and age you have to be very mindful of what comments you make about whom. There is the potential for people/companies to firstly take offence at "Comments" then secondly take some kind of action be it legal/social/Job.

Cheers,

Simon T

Noggers / Elly,

Firstly I would like to say thanks for your most valuable input (especially that of Elly)

This company is still thinking I breached my privacy agreement with them and now have started threatening me.

(before I continue I would like to state I am only seeking advise and unless it is explicitly said on your reply that I can, I will not use anything you say as a copy and past reference of any kind, this is mealy guidance to know where I stand)

To clarify what I had done, I had posted on my facebook as a bit of a joke with some mates of mine this:

"I find it very scary that {REMOVED COMPANY NAME} still has {INSERT NETNAME FROM WHOIS} set to extremely old information (including myself being the contact :S )
and its still set to MAINT-NEW????? Jesus."

I have replaced the information regarding the company for obvious reasons :)

So, other than the fact its an immature post am I in the wrong legally?
have I legally breached something?
have I in fact broken my privacy agreement (which is what they are saying I have done) ?

Sorry this is more of a law question, but your opinions are valuable to me!

Cheers!
Karl Kloppenborg

Thanks Elly.

I know we have spoken about this before, and at the risk of banging on about it again, but....

If the abuse / other IP allocation contact information is *not* up to date / stale / wrong, how will APNIC contact the entity to have it corrected ?

The amount of time and effort my team has wasted chasing people, particularly in China and Singapore, to fix their rogue hosts amounts to hundreds of hours.

Because these entities are usually attacking our Government clients, we must follow up until we get an outcome or block their respective networks / ISPs, which really is not a great answer.

The other challenge we have is when we do get hold of someone, they don't speak English.

Surely there must be a better way to do this.

Hi AUSNOGers

Thanks for the interesting discussion. I hope these comments help answer your questions.

Is APNIC data Private?
As p8x quoted APNIC has a privacy statement that says that some information is publicly registered. See information below:

"Some of the personal information you provide may be publicly registered in the APNIC Whois Database. This is limited to contact details relating to the allocation of specific public Internet resources."

Can people publish WHOIS data?
There is information listed on our APNIC Whois Database Acceptable Use Agreement.

"Except for Internet operational purposes approved by APNIC, no part of the APNIC whois data may be reproduced, stored in a retrieval system, or transmitted, in any form or by any means, electronic, mechanical, recording, or otherwise, without prior permission of APNIC on behalf of the copyright holders. Any use of this material to target advertising or similar activities is explicitly forbidden and will be prosecuted. APNIC requests to be notified of any such activities or suspicions thereof.

The APNIC whois data may not be passed on in bulk to any other person or organization unless approved by APNIC."
-whois/copyright)

In other words you must ask APNIC for permission to publish the information other than for Internet operational purposes.

In terms of invalid contact details in the APNIC Whois Database, you can submit details using the invalid contact report form and we will follow it up from:

http://www.apnic.net/apnic-info/whois_search2/using-whois/updating
-whois/invalid-contact

If you have any questions or require assistance with APNIC whois database updates, please contact the APNIC helpdesk:

Kind regards,
Elly

Hey Noggers,

this is probably just another silly question, but I am having a
dispute with someone over them claiming that whois information is
private information about their company and thus I can't post it
anywhere I want.
Ie, post the whois with a comment on a public domain / forum.

I claim that this is indeed public information and can be used by anyone?

However I thought before I make a total idiot out of myself I would
ask you just incase I am wrong and the details are infact "Confidential"
