Dear service provider,
I am writing to update you on the progress and timing of the grants
programme to distribute up to $128.4 million to industry to assist
implementation of the data retention obligations. The Data Retention
Implementation Working Group, comprising representatives from industry and
government, will meet in coming weeks to finalise the model for
distributing funds to industry participants. Details of the funding model
will be made public in November 2015.
Carriers, carriage service providers and internet service providers
undertaking work to meet their obligations may be eligible to apply for a
grant. Only providers that have lodged a data retention implementation
plan, identifying the work they will undertake to achieve compliance, will
be eligible for a grant. This process will give industry an opportunity to
provide the Attorney-General’s Department with more information on its
needs. The programme will take account of Recommendation 16 of the
Parliamentary Joint Committee on Intelligence and Security’s Advisory
report on the Telecommunications (Interception and Access) Amendment (Data
Retention) Bill 2014, including providing adequate support for smaller
providers.
Grant programme guidelines will be made available when the programme opens
in December. The grants round is expected to close in late January 2016,
with the first payments made in the first half of 2016. As you know, while
the data retention obligations come into force on 13 October 2015, the 18
month implementation period means that industry has until 13 April 2017 to
transition their systems to full compliance. Further payments will be made
at the end of the implementation period.
