You could still gain access to the archives, but only under the conditions of your subscription, conditions which reflect the openness of the list, without the risk of being quoted by the media.

There’s no reason why a journalist couldn’t still subscribe to the list, however they wouldn’t be able to use the content of the list without approval from the mods, and the author of the email.

Most of the information isn't controversial and I would hate to see nog closed to a private membership model.

As mentioned there is already a charter that is enforced. People always have the option to not reply-all and state their 'private' correspondence off-list.

Agreed, however you can have a list charter/rules/terms and conditions which your subscription is subject to. You can’t do effectively the same a public facing archive.
