This issue was raised in Estimates week before last: Ludlum asked if someone could evade having their email traffic data retained by just using gmail.

Brandis’ response was along the lines of, “Well, if someone wants to behave like a criminal, then …”

So yes, in Soapy’s world, using gmail to evade data retention is suspicious behavior, and people who are behaving criminally aren’t seriously expected to be caught by the scheme.
