As with all things BGP, both ends need to agree upon it. You can't set your 'local-as' to be the same as the remote peer without them doing the same (ie. setting the AS for your end to be that number). You should also realise that if both ends have the same AS configured (whether natively or via loca/remote-as) then you effectively have an i-BGP connection not an e-BGP and some different rules apply.
Either way as stated you only have one BGP process (with one AS) and you can use local-as to be a member of the second AS locally.

The problem is I can't believe you can use this and have the same ASN as the other peer? I could be wrong.
