IIRC, that one was a little more hairy than that article would have you
believe.  The argument wasn't just that Comcen was the hosting provider, it
was that they had a relationship that extended beyond what you would
normally expect from an ISP / customer.

The case largely hinged around that:
A) Comcen had administered the site
B) had been aware of the content
C) had provided the hosting for free in exchange for free advertising.

This wasn't regular old providing of service to someone who used it for
something illegal, they alleged that Comcen were actively involved in it.
