This has been extensively covered today.

Additional "middle ground" possibilities include (non-exhaustively):

Some unis might conduct their affairs in ways that raise retention obligations, while some don't,
Some unis might be subject to section 187A(3A), and some are not,
Some unis might have access to other sources of funding; and
Some unis might be absorbing the cost themselves.

Occam's Razor: Both sides of the dichotomy you've painted above leave your reader to ponder whether some of the most respected and venerable institutions in our society are corrupt and/or operating unlawfully. When contemplating a smear like that, it's wise to consider that maybe some factor you haven't considered could be at play.
