No need for a test case, see "Telstra Corp Pty Ltd v First Netcom Pty Ltd"

In summary, the court restrained Telstra from discontinuing services due to non-payment. Read the case, this was a significant non-payment.

It may also be worth noting that the court would have allowed discontinuing service if the customers had access to another source of the service.
